LEGAL PURCHASE AND DELIVERY OF A HOUSE

Anyone who purchases a house in the Netherlands will encounter two legal transactions: the purchase and the delivery. This applies to both existing homes and new constructions. Firstly, the purchase agreement – on paper – is signed. This contract contains the agreements about matters such as the purchase price and the date upon which the purchaser takes possession of the house. Many people refer to this as the provisional deed of sale. However, there is nothing provisional about this agreement. As soon as both parties agree on the content of the agreement and have signed it, they are in principle committed to the sale.

PURCHASER RECEIVES PROTECTION

Even after the deed of sale has been signed by the purchaser and the seller, however, the purchaser still has the opportunity to withdraw from the sale. The purchaser has a reflection period of three days and is therefore protected. During these three days, the purchaser may still reconsider his/her intention to purchase the house.

NOTARIAL DEED, DEED OF TRANSFER AND CADASTRE

Once the deed of sale has been signed, the notarial deed must be drawn up. The civil-law notary draws up the delivery deed and once it has been signed, registers it with the cadastre. This makes the ownership a fact. The purchaser later receives the document registered with the cadastre as proof of ownership.
